Terms and Conditions of the Online Store https://cricoteka.pl/shop/
§ 1. Definitions
Store – the online store operating at www.cricoteka.pl/shop/, run by the T. Kantor Art Documentation Center “Cricoteka,” registered in the Register of Cultural Institutions RIK 9/99, with NIP 675-10-00-601, Regon 000870706, and located at ul. Nadwiślańska 2-4, Kraków; Client – a person placing an order in the Store; Product – items offered for sale in the Store; Terms and Conditions – these Terms and Conditions, prepared in accordance with the Act of May 30, 2014 on consumer rights and the Act of July 18, 2002 on the provision of electronic services.
§ 2. Order Acceptance and Fulfillment
Orders are accepted through the website www.cricoteka.pl/shop/.
To place an order in the Store, a device capable of browsing web pages and an email address are required.
Immediately after placing an order, the Client receives a confirmation of the order to the provided email address.
The order is accepted for fulfillment after the Store receives the Client’s confirmation in response to the email mentioned in § 2, section 3 of the Terms and Conditions.
The order is processed after verifying the availability of the Products and after payment is received. If some of the Products in the order are unavailable, the Client will be informed about the status of the order and will decide on how to proceed (partial fulfillment, extended waiting time, cancellation of the entire order).
A limited number of Products are allocated for promotional sales or clearance, and orders for these Products are fulfilled on a first-come, first-served basis until stocks allocated for this type of sale are depleted.
At the Client’s request, a VAT invoice is issued. The VAT invoice is issued after the availability of the Products is confirmed and they are prepared for shipment.
The Client may make changes to the order until the Product is shipped or the invoice is issued.
The Client may cancel the entire order until it is shipped.
Modifying or canceling the order in accordance with § 2, sections 7 and 8, is possible by contacting Customer Service via email at sklep@cricoteka.pl.
All prices are listed in Polish zloty (PLN) and include VAT. The price listed for each Product is binding at the time the Client places the order. The Store reserves the right to change the prices of Products in the offer, introduce new Products to the online store’s offer, conduct and cancel promotions on the Store’s website, or modify them.
The shipping fee includes the delivery cost calculated according to the Polish Post’s price list, proportional to the weight and size, as well as packaging costs. Posters are shipped in a separate tube. The total shipping cost is provided in the “order summary” before the final order is placed.
Orders are processed on the day the payment is credited to the account.
Orders are shipped every Thursday and include orders placed and paid for by the previous day (Wednesday).
The Client may choose the following payment methods for the ordered Products:
- bank transfer to the Store’s account;
- PayPal.
§ 3 Right of Withdrawal
The Client may withdraw from the contract without giving any reason within 14 days of receiving the Product or from the date of the contract if the contract does not involve the physical delivery of the Product. Sending a written statement within this period is sufficient to meet the deadline. The statement can be made using the form attached to these Terms and Conditions. Upon withdrawal from the contract, the Store will refund the Client the full amount paid, including the cost of the purchase and delivery, within 14 days, but no earlier than upon receiving the returned Product or confirmation of its return from the Client. The refund will be made in the same manner as the payment. The refund of delivery costs will be limited to the cost of the cheapest shipping method offered by the Store. The Client is obliged to return the Product to the Store within 14 days from the withdrawal. The Client is responsible for covering the cost of returning the Product. The right of withdrawal does not apply to the purchase of audio or visual recordings delivered in sealed packaging if the packaging has been opened after delivery. The right of withdrawal does not apply to the purchase of periodicals or magazines. The right of withdrawal does not apply to digital content not stored on a physical medium, provided the Client consents to the performance of the contract before the withdrawal period expires. The Client is responsible for any decrease in the value of the Product resulting from its use beyond what is necessary to determine the nature, characteristics, and functioning of the Product.
§ 4 Complaints
The Store undertakes to deliver the Product without defects. In the event of mechanical damage occurring during delivery or a direct complaint to the seller, the Client should return the defective product via postal shipment to the Store’s address. The Store does not accept parcels sent with cash on delivery. The returned Product should be accompanied by a copy of the invoice or receipt and a complaint statement specifying the reasons for the complaint. Complaints are processed within 14 days of submission. In the case of a justified complaint, the defective Product will be repaired or replaced with a new, faultless one. If this is not possible, the Store will refund the price of the product or offer another Product available in the Store. The Store will immediately refund the shipping costs related to returning the Product upon a positive resolution of the complaint. Differences in the appearance of the Products delivered and those ordered, as viewed on the Store’s website, that may result from different monitor settings (parameters), do not constitute grounds for complaint. A complaint should be submitted in writing or via email to sklep@cricoteka.pl.
§ 5 Final Provisions
The sales agreement is concluded between the Client and the T. Kantor Art Documentation Center “Cricoteka,” 30-527 Kraków, ul. Nadwiślańska 2-4. The essential terms of the agreement are recorded, secured, and made available by printing and delivering the VAT invoice to the Client along with the shipment. The sales agreement for Products is concluded in accordance with Polish law and in the Polish language. The court competent to resolve disputes arising from the sales agreement is the court competent under general rules, i.e., the court competent for the defendant’s registered office or the court competent for the place where the agreement is performed.
